Not Tired of Winning XCIII

This week, in addition to Christmas and the Feast of Stephen, we celebrate the Feast of the Holy Innocents, and remember those children slaughtered by King Herod. It seems an appropriate time.

Over 200 lawmakers (including two Democrats) signed an amicus brief to the U.S. Supreme Court in support of the Louisiana pro-life law it is considering.

The brief is here.

The friends of the court signing ” respectfully suggest that the court’s struggle—similar to dozens of other courts’ herculean struggles in this area—illustrates the unworkability of the “right to
abortion” found in Roe and the need for the Court to take up the issue of whether Roe and Casey should be reconsidered and, if appropriate, overruled. ”

Stare decisis is not an “inexorable command,” much less a constitutional principle. ”

“”Furthermore, Roe’s jurisprudence has been haphazard from the beginning. Roe did not actually hold that abortion was a “fundamental” constitutional right, but only implied it. This ambiguity was compounded by the Court’s concluding “summary” of the Roe holding, which nowhere mentioned abortion as a fundamental right, strict scrutiny analysis, or the need to “narrowly tailor” regulations. Instead, the Court only required that regulations be “reasonably relate[d]” to the State’s interest and “tailored to the recognized state interests.” The cases decided since did not consistently treat abortion as a “fundamental right” and did not consistently apply strict scrutiny.”

Technically, this is not something President Trump did or set in motion. However, he did appoint honest judges to the Supreme Court rather than dishonest, what the orcs call “Activist” judges.

Would such a snowball have started rolling had Hillary been elected?

I would say that, had she won, the three Democrat lawmakers who signed this document would have been found dead in the Metropolitan Correctional Center, next to Jeffrey Epstein, or in Fort Marcy Park, next to Vince Foster.

You see, Roe v Wade was decided back when the Progressives had not progressed so far down the road of good intentions, and the political illness had not metastasized into whitewashing Jihadists who massacre queers in nightclubs, but vilifying armed parishioners who halted a massacre in church.

Now progressives are more progressed.

Had Hillary been elected, her court picks would greatly simplify the holding in Roe v Wade by decreeing all babies impaled through the skull, brain-sucked, dismembered, and organ-harvested for sale on the black market, to be suicides.
