Ohio defunds Planned Childmurderhood.

The US Court of Appeals for the Sixth Circuit ruled 11-6 Tuesday that Ohio can enforce a 2016 law preventing Planned Parenthood, and any other organization that “performs or promotes nontherapeutic abortions” from receiving state funds. The decision by the en banc court overturns a ruling by a three-judge panel that the state could not enforce the law.

In its decision, the court recognized that the law did place a condition on the funding, but found “that the condition was constitutional because that condition does not violate the Constitution because the affiliates do not have a due process right to perform abortions.”

The decision is a blow to Planned Parenthood, which has 26 locations in Ohio. Locations in Bedford Heights, Columbus and Cincinnati provide abortions, while the others provide health services for men, women and children. The state is now free to enact the law.

The Ohio law, passed by a Republican-controlled legislature and signed by then-Gov. John Kasich, forbids the state from contracting for health services with any entity that performs or promotes non-therapeutic abortions.

Planned Parenthood of Greater Ohio and Planned Parenthood of Southwest Ohio Region… sued after Kasich signed the law to cut off more than $1 million from them.
